A detailed procedure used to issue summons to individuals needed to be brought in for police investigation or other reason, has been established.

The procedure details three ways individuals can be issued a police summons, i.e. delivering a chit, via phone or in person. The summons should be delivered 24 hours before the recipient is to be present at the police stations. The procedure also states that if the chit cannot be delivered to the recipient, it can be delivered to an adult living in the residence of the recipient.

If the recipient is unavailable and any adult living in the residence of the recipient refuses to accept the summons, it can be sent via registered post or other forms of communication.

In the case of summons being issued through other forms of communications, delivery reports and automatic ‘seen’ messages will be taken as confirmation that the summons has been delivered. The other forms of communications include email, fax, text message, and social media applications through which photos can be sent.

According the procedure, in the case a recipient is abroad, a time period between three or seven days will be given. The period could also be extended by contacting the police with a valid reason. The accepted reasons include the recipient being hospitalized or being unable to travel due to medical reasons, the recipient is a caretaker of someone who is hospitalized, or being unable to travel due to flight schedules.

If the recipient is abroad and the police is unable to contact individual, a public announcement for the summons will be made. The recipient has a time period of three to seven days to appear at the police which could also be extended by contacting the police with a valid reason.

Failure to appear after a summon order will be investigated as a separate case and will be filed at the Prosecutor General’s Office.
